    Despite witnessing a turbulent week after taking one of the difficult decisions of her life -- to divorce superstar husband Tom Cruise, former Dawson's Creek star Katie Holmes is ''all right'' and determined to ''play tough'' against Tom over Suris custody issue. The actress told New York's Daily News yesterday while she was shopping for groceries like barbecue supplies, including hamburger meat, buns, strawberries and bananas along with her attorney father Martin Holmes, ''I'm all right. Thank you. Her six-year-old daughter Suri also accompanied her on the trip. The mother and daughter spent that day getting ice cream in the East Village area. According to eyewitnesses, ''Katie looked happy and was friendly to the customers and staff while Suri sat on her mum's lap.'' In the meantime, Tom Cruise, who turned 50 on July 3, didnt celebrate his birthday and spent the whole day with his adopted children with second wife Nicole Kidman-- Isabella, 19, and 17-year-old Connor -- at his Beverly Hills mansion. A source said: ''The plan was he was going to spend his birthday with Katie and Suri in New York City Then they were going to fly to California where he is going to finish [filming] Oblivion and spend time there. But he had to change his plans. The source added, ''All of Tom's family were together, and one of the reasons he came back to California was that he had to take his family back to LA. The source said that the actor was not in a celebration mood and missed his first biological child Suri a lot. ''Say what you will about Tom, but there is no doubt he loves his daughter. Not seeing her would be very hard on him. His mood was sombre. Just very very sad, the source added. But it doesnt seem that he will be able to bring Suri back to his family with Katie planning to do anything or everything to get the sole custody of the child. Katie had also filed for an emergency custody and child support hearing in New York on July 3. A close source said, ''It's a motion seeking temporary emergency relief, which can include child support and custody. It also means that Tom is going to have to hire a New York lawyer - he can't use his California lawyer anymore. The motion also means that both Tom and Katie have to be present in court on July 17. A judge is now assigned to their case, which means it's no longer going to be an out-of-court settlement. They are scheduled to appear before Judge Matthew Cooper on July 17 at 9:30am.'' The actress is willing to ''play tough'' against Tom and has hired top lawyer Allan E. Mayefsky to represent her in the case. Well-known legal analyst and author Lisa Bloom was also quoted as saying by The Daily Beast: ''She's making it clear she's going to play tough. Cruise is more of a high-profile celebrity than she is, so he has a greater distance to fall if grievances are aired. Everyone has dirty laundry they don't want aired. She's saying play fair with me or else. Of course she would choose an experienced and tough lawyer. But the fact that she'd choose someone who's been known to go to media in the past signals that she might have hired him for that reason.'' Lisa said, ''Katie has really good, nasty, horrible lawyers and she should do really well.''
